Privacy Statement

This statement describes how Certified Public Accountant and Tax Consultant DDr. Walter Baumann and BAUMANN CONSULT Management and Audit GmbH in 1190 Vienna, Maulbertschgasse 6 ("we") process your personal data. The statement is addressed to our clients, interested parties, potential future clients, as well as their respective shareholders, executives, and other employees.

We have implemented appropriate technical and organizational measures to ensure that there is no unauthorized access to (or unlawful processing of) the provided personal data. The technical and organizational measures include access authorization concepts, data backup concepts, as well as physical and digital security measures regarding our IT infrastructure.


1. Purposes of Data Processing

We will process your personal data for the following purposes:
  • Establishment, administration and execution of the business relationship
  • Strengthening existing client relationships or establishing new client relationships
  • Contacting prospective clients, including sending information about current legal developments and our service offerings (marketing)
  • Internal organization and damage management of the firm in case of an existing engagement
  • Payroll processing for clients (including monthly payroll and salary processing, monthly and annual reporting to authorities, etc.)
  • Financial and business accounting for clients
  • Providing advice and representation in the field of tax law and business
  • Consultation and representation in the social insurance field
  • Representation before administrative courts and authorities, as well as before legally recognized churches and religious communities in contribution matters and before all other governmentally active institutions
  • Other consultation, as well as taking over trustee tasks and managing assets within the scope of § 2 WTBG 2017
  • Exercising the function of a trustee, supervisory board member, foundation board member, executive or board member
  • Leasing of real estate and other assets
  • Acting as a court expert, expert, speaker or author
  • Any commissioned task according to § 2 WTBG 2017
  • Consultation and assistance in the field of accounting and financial reporting and the preparation of corporate books
  • Providing all consulting services and activities related to corporate accounting
  • Consultation regarding the establishment and organization of an internal control system
If we collect your personal data from you directly, providing your data is generally voluntary. However, we may not be able to fulfill our mandate or do so completely if you do not provide your personal data.


2. Legal Basis of Processing

We process your personal data because it is necessary to fulfill the contract we have with you (Art. 6 (1) (b) GDPR) and for the purpose of fulfilling various legal obligations. Furthermore, we process your personal data on the basis of our predominant legitimate interests in achieving the purposes mentioned under point 1 (Art. 6 (1) (f) DSGVO) and on the legal basis of the WTBG 2017 (Art. 9 (2) (g) DSGVO).


3. Data Recipients

Where necessary for the purposes mentioned under point 1, we will transmit your personal data to the following recipients:
  • IT service providers used by us and other service providers in connection with marketing activities
  • Administrative authorities, courts, and public-law corporations
  • Chartered Accountants for auditing purposes
  • Insurance companies on the occasion of concluding an insurance contract about the service or the occurrence of the insurance event (e.g. liability insurance)
  • Clients, to the extent they concern data of the shareholders, executives and other employees of the respective client
  • Cooperation partners and legal representatives acting on our behalf
  • Other recipients designated by the client (e.g. client' s group companies)
  • In addition, in the case of personal data of employees of our clients in the field of payroll processing: Creditors of the employee and other parties involved in potential legal enforcement, including voluntary salary assignments for due claims
  • Representatives of business and legal interest representation
  • Insurance companies within the scope of an existing group or individual insurance and employee pension funds (MVK)
  • Banks involved in payments to the employee or third parties
  • Occupational physicians and pension funds
  • Co-insured parties
  • Furthermore, in the area of financial and business accounting for clients: Collection agencies for debt collection, Banks acting on behalf of the client, Factoring companies, assignees and leasing companies.
Some of the recipients mentioned above may be located outside of Austria or process your personal data outside of Austria. The level of data protection in other countries may not correspond to that of Austria. Therefore, we take measures to ensure that all recipients provide an adequate level of data protection. For example, we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC). These are available upon request (see point 6).


4. Storage Period

We store your personal data generally until the termination of the business relationship in which we collected your data or until the expiration of the applicable statutory limitation and retention periods; furthermore, until the termination of any legal disputes where the data is needed as evidence. If you are a client, former client, prospective client, or a contact person for any of the aforementioned, we will store your personal data for marketing purposes until you object or withdraw your consent, provided that the marketing measure is based on your consent.


5. Your Rights Regarding Personal Data

You are entitled, among other things, (i) to check whether and which personal data we process about you and to receive copies of this data, (ii) to request the correction, completion, or deletion of your personal data, if it is incorrect or not processed lawfully, (iii) to demand that we restrict the processing of your personal data, (iv) to object to the processing of your personal data under certain circumstances or to revoke your consent given for processing, whereby a revocation does not affect the lawfulness of the processing carried out before the revocation, (v) to request data portability, provided you are our client (vi) to know the identity of third parties to whom your personal data is transmitted, and (vii) to file a complaint with the data protection authority.

In case of a breach of the protection of personal data (data breach), the contracting party causing or responsible for this data protection incident shall decide on whether to report it to the subject concerned and/or the data protection authority.

For the deletion of personal data, both the client and we are responsible for our respective areas of responsibility.
